These General Terms and Conditions (“Terms”) govern all orders placed through the website infinytree.com, operated by:

By placing an order, you agree to these Terms. Please read them carefully before making a purchase.
1. Scope & Definitions
These Terms apply to all contracts concluded between Infinytree, operated by Deltalivings Kft. (“Seller”, “we”, “us”), and the customer (“Buyer”, “you”) through our online shop. The Buyer may be a consumer, meaning a natural person acting outside their trade, business or profession, or a business customer.
Deviating terms of the Buyer are not recognised unless expressly agreed to in writing.
2. Products
Infinytree sells artificial botanical pieces, including artificial trees, plants and floral arrangements. Our products may be offered as standard products or as configured artificial tree compositions.
For configured artificial tree compositions, the customer selects the tree colour and planter/pot, and may select other available options during the order process. The final composition is assembled, prepared and finalised after the order according to the customer’s selected configuration.
Each piece may be unique and may slightly differ from the images shown on the website.
Variations in trunk shape, foliage distribution, planter appearance and overall dimensions may be inherent to the product and assembly process and are not defects unless they materially differ from the confirmed order specification.
Product photographs serve as representative samples; they do not constitute a guarantee of identical appearance unless expressly stated.
3. Contract Conclusion
The presentation of products on our website does not constitute a binding offer. It is an invitation to submit an order.
You place an order by completing the checkout process and clicking “Place Order” or an equivalent order button.
You will receive an automated order confirmation by email acknowledging receipt of your order.
A binding contract is formed when we accept the order by email, send a shipping confirmation, or deliver the goods.
4. Prices & Payment
4.1 Prices
All prices displayed on the website are in Euros (€) and include the applicable Value Added Tax (VAT) as required for sales to consumers in the EU. Shipping costs are displayed separately during checkout before you confirm your order.
4.2 Payment Methods
We accept the payment methods displayed at checkout, which may include:
Credit card (Visa, Mastercard, American Express)
Apple Pay / Google Pay
Additional methods as displayed at checkout
Payment is processed securely via Stripe or the payment provider displayed at checkout. Payment is due at the time of order unless otherwise stated.
5. Delivery
5.1 Shipping Zones
We currently ship to Austria, Germany and Hungary. Deliveries to other countries may be available on request - please contact us at info@infinytree.com.
5.2 Delivery Times
Estimated delivery times are provided during checkout and in our Shipping Policy. Delivery times are estimates and not guaranteed deadlines unless expressly agreed otherwise.
5.3 Transfer of Risk
For consumers, the risk of accidental loss or damage passes to you when the goods are handed over to you or to a person designated by you, other than the carrier. For business customers, the risk passes upon handover of the goods to the shipping carrier, unless mandatory law provides otherwise.
6. Right of Withdrawal (Consumers Only)
6.1 General Rule
If you are a consumer within the European Union, you generally have the right to withdraw from a distance contract within 14 days without giving any reason, unless a statutory exception applies.
6.2 Exclusion for Configured Products
The right of withdrawal does not apply to non-prefabricated goods made on the basis of the consumer’s individual choice or decision, or goods clearly personalised for the consumer. This includes products falling under Section 29(1)(c) of Hungarian Government Decree 45/2014 (II. 26.).
Configured Infinytree artificial tree compositions are assembled and finalised after the order according to the customer’s selected tree colour, planter/pot and any other selected configuration options. Therefore, where a product is ordered as a configured product, the 14-day statutory right of withdrawal does not apply.
6.3 Checkout Acknowledgement
For configured products, you must acknowledge during checkout that the product will be individually assembled and finalised based on your selected options and that the 14-day withdrawal right does not apply to such configured products.
6.4 Where Withdrawal Applies
If a product is expressly sold as a standard, non-configured product and no statutory exclusion applies, the withdrawal period expires 14 days from the day on which you or a third party indicated by you, other than the carrier, acquire physical possession of the goods. To exercise the right, send a clear statement to info@infinytree.com. You may use a model withdrawal form where provided, but it is not obligatory.
6.5 Effects of Withdrawal
Upon valid withdrawal, we will reimburse eligible payments received from you, including the standard initial delivery costs, without undue delay and in any event within 14 days from the day on which we are informed of your decision to withdraw. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is earliest.
6.6 Return of Goods
If withdrawal applies, you must send back the goods without undue delay and in any event within 14 days of informing us of your withdrawal. The direct cost of returning the goods is borne by you unless mandatory law provides otherwise. Products should be returned in their original condition and packaging where reasonably possible.
6.7 Diminished Value
You are liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
7. Damaged or Defective Products
We do not provide any voluntary commercial warranty or guarantee unless expressly stated for a specific product. This does not affect mandatory statutory rights that cannot be excluded under applicable law for damaged, defective or materially non-conforming products.
If a product arrives damaged, is defective, or materially does not conform to the confirmed order specification, please contact us at info@infinytree.com with your order number and photographs or a description of the issue.
We will assess the reported issue and, where required by applicable law, provide the appropriate remedy, such as repair, replacement, price reduction or refund.
Minor visual differences inherent to individually assembled artificial botanical products, including variations in trunk shape, foliage density, arrangement, texture or dimensions, do not constitute defects unless the product materially differs from the confirmed order specification.
8. Limitation of Liability
Our liability is limited to the extent permitted by applicable law:
We are fully liable for damages caused by intent or gross negligence.
For slight negligence, our liability is limited to foreseeable, typical damages and only in case of breach of material contractual obligations, to the extent permitted by law.
This limitation does not apply to claims based on product liability, injury to life, body or health, or mandatory statutory provisions.
9. Product Use & Care
Products are designed for indoor use only unless the product page expressly states otherwise. Permanent outdoor exposure may cause damage that is not treated as a defect where the damage results from such use.
Products are maintenance-free: no watering, sunlight or special care is required.
Keep products away from direct heat sources, open flames and prolonged direct sunlight to preserve colour and material integrity.
Products are artificial and do not release pollen.
10. Intellectual Property
All content on this website - including photographs, product descriptions, logos, designs and graphics - is the property of Infinytree, Deltalivings Kft. or its licensors and is protected by copyright and intellectual property laws. Reproduction, distribution or use without our prior written consent is prohibited.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of Hungary, without prejudice to any mandatory consumer protection provisions of your country of habitual residence that may provide you with additional rights.
For consumers, disputes may be brought before the courts of your place of residence or the competent courts under mandatory consumer protection rules. For business customers, the exclusive place of jurisdiction is Budapest, Hungary, to the extent permitted by law.
12. Consumer Dispute Resolution
Before initiating any formal dispute resolution procedure, please contact us at info@infinytree.com so that we can try to resolve your complaint directly.
Consumers may contact the competent conciliation body. For Deltalivings Kft., the competent local body is the Budapesti Békéltető Testület, 1016 Budapest, Krisztina krt. 99., postal address: 1253 Budapest, Pf.: 10., email: bekelteto.testulet@bkik.hu, telephone: +36 (1) 488-2131. We cooperate with conciliation proceedings as required by applicable law.
The former European Commission Online Dispute Resolution (ODR) platform has been discontinued as of 20 July 2025.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the economic intent of the invalid provision, to the extent permitted by law.
14. Amendments
We reserve the right to amend these Terms at any time. Changes take effect upon publication on this website. Orders already placed remain subject to the Terms in effect at the time the order was placed.
